These Terms of Use ("Terms") govern your access to and use of the Examzify website, mobile apps, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

By using Examzify, you confirm that you are at least the age of majority in your jurisdiction or that you have permission from a parent or legal guardian to use the Service. If you do not agree to these Terms, you must not access or use the Service.
Examzify provides online and mobile tools to help users prepare for exams, including practice questions, explanations, flashcards, progress tracking, and other study resources. Examzify is an independent service and is not officially endorsed, sponsored, or approved by any exam body, licensing authority, or educational institution unless explicitly stated.
Some parts of the Service are offered on a paid subscription basis ("Subscription"). When you purchase a Subscription, you will be charged the price displayed at the time of purchase, plus any applicable taxes. Unless otherwise stated, Subscriptions automatically renew at the end of each billing period until canceled.
If you purchase a Subscription through a third-party app store (such as Apple’s App Store or Google Play), your billing relationship is with that app store, and additional terms of the app store apply. Billing, renewal, and cancellation are managed through your app store account, and any refunds are subject to the app store’s policies.

If you purchase directly through the Examzify website, payments are processed by our third-party payment providers (for example, Stripe). By submitting payment information, you authorize us and our payment providers to charge the applicable fees to your chosen payment method.
From time to time, we may offer free trials or promotional pricing. If you sign up for a Subscription with a free trial, your Subscription may automatically convert to a paid Subscription at the end of the trial period unless you cancel before the trial ends. The specific terms of any promotion will be shown at the time of sign-up.
We may change the price of Subscriptions from time to time. For existing Subscriptions, we will provide advance notice of any price change in accordance with applicable law. Continued use of the Service after a price change takes effect constitutes your agreement to the new price.
Subject to these Terms, Examzify grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial exam preparation.

By submitting User Content, you grant Examzify a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display that content for the purpose of operating and improving the Service.
You represent that you have the necessary rights to submit any User Content and that your User Content does not infringe the rights of others or violate any law.
The Service, including all content, questions, explanations, text, graphics, logos, and software, is owned by Examzify or its licensors and is protected by copyright and other intellectual property laws. Except for the limited license granted to you in these Terms, no rights are transferred to you.

Examzify provides study tools to help you prepare for exams, but we do not guarantee any particular exam result, score, or outcome. The content is for educational purposes only and may not reflect the most recent changes to official exams, laws, or regulations. You are responsible for confirming official requirements with the relevant exam body or authority.
The Service may integrate with or link to third-party services, such as payment processors, analytics providers, ad networks, and app stores. Your use of those third-party services is subject to their own terms and privacy policies. Examzify is not responsible for third-party services that we do not control.
If you access the Service through Apple’s App Store, you acknowledge that these Terms are between you and Examzify, not Apple. Apple is not responsible for providing any maintenance or support for the Service, except as required by Apple’s policies. To the maximum extent permitted by law, Apple has no liability for any claims arising from your use of the Service.
Your use of the Service through the App Store is also subject to the Apple Media Services Terms and Conditions or other applicable platform terms.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Examzify disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate, complete, or up to date.
To the fullest extent permitted by law, Examzify, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or in connection with your use of the Service.
In jurisdictions where limitations of liability are not permitted, our liability will be limited to the maximum extent permitted by law. In all cases, Examzify’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service during the twelve (12) months prior to the event giving rise to the claim.
You agree to indemnify and hold harmless Examzify, its directors, employees, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may stop using the Service at any time and, where applicable, cancel your Subscription through your account or app store settings.
Upon termination, your right to use the Service will cease, but the provisions of these Terms that by their nature should survive (such as intellectual property, disclaimers, and limitations of liability) will remain in effect.
These Terms and your use of the Service will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless applicable law requires otherwise.
We may update these Terms from time to time to reflect changes to our practices, the Service, or applicable law. When we make material changes, we will update the "Last Updated" date below and may provide additional notice as required. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
